First identify the legal issues

(Employment Law)

Tiana offers to sell her car to Chrysanthe. She tells Chrysanthe that it is two years old and is in very good order. Tiana tells her, ‘The car is very reliable and has had one careful owner. I am selling this to you for £5000 only’. Chrysanthe points out that the tyres are worn and Tiana assures her that if she decides to buy the car she will replace them. Chrysanthe spends the rest of the day checking on car prices and that evening tells Tiana that she will buy the car at the price offered by Tiana. The day after buying the car Chrysanthe notices that the tyres have not been replaced. Three weeks later Chrysanthe finds out that the car is five years old (although there is no evidence that Tiana knew this) and has had 2 previous owners before Tiana. Six months later Chrysanthe is involved in an accident in the car and finds out from a car repairer that the chassis has been welded together from two different cars, indicating that the car is not road worthy.

For a case study please follow the following :

The answer should start by identifying the following when answering

I – Issues

R – Relevant law

A – Application

C – Conclusion

You don’t need an introduction

  • First identify the legal issues. These should be stated briefly in one sentence. There is no need to enlarge on the issues, as this will be done in the application section.

  • Secondly, take each issue in turn and set out the relevant law relating to that issue. All relevant cases and statutory provisions should be mentioned. Names of cases and statutes should be italicised. It is not necessary to give the facts of every case. The most important thing to set out is the legal principle decided in that case.

  • Next, the law should be applied to the facts of the problem question. This may be done immediately after you have set out the relevant law on each issue, or you may wait until you have set out the law on all the issues, as has been done below. There is no need to repeat the legal principles set out in the relevant law section.

  • Finally, state your conclusions. Again, there is no need to repeat what you have already set out in the previous sections. The conclusion should be brief. If there is more than one possible conclusion, set them all out.
